This website is operated by Te Kōhanga Reo National Trust and its wholly owned subsidiary Te Pātaka Ohanga Limited. Throughout the site, the terms “we”, “us”, “our” and “The Trust” refer to Te Kōhanga Reo National Trust and Te Pātaka Ohanga Limited.

The Trust offers this website, including all information, applications, systems, products, and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies, and notices stated here or linked (including by hyperlink) to this site (collectively “these Terms” or “the Terms”).

By visiting, using, or accessing our site and / or purchasing something from us, you engage in our “Service” and agree to be bound by our terms which apply to all users of the site, (including browsers, vendors, customers, merchants, and content contributors).

If you do not agree to all the Terms, you may not access the website or use any services.

Any new features, applications or functionality of any nature added to the website, are also subject to these Terms. You can review the most current version of the Terms at any time on this page. We may update, change, or replace any part of these Terms by posting updates and / or changes to our website. It is your responsibility to check this page periodically for changes. Your use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our website includes a link to our online store hosted on Shopify, a third-party e-commerce platform. Purchases are processed through Shopify’s secure checkout system. As Shopify is an independent platform, transactions are subject to both these Terms and Shopify’s own terms of service and privacy policy. We recommend reviewing Shopify’s terms and privacy policy before making a purchase.If there is any inconsistency between these Terms and Shopify’s terms regarding the purchase process, payment, or refund procedures, Shopify’s terms will take precedence for those specific matters.

By agreeing to these Terms, you represent that you are at least 18 years old, and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the service, violate any New Zealand laws.

You must not transmit any worms or viruses or any code of a destructive nature. Also be aware there may be restrictions on user uploads.

If you breach any of the Terms and we become aware of the breach, we will act to minimise the impact. Where costs incurred are attributable to your breach, we may take steps to recover these. Your access to services may also be terminated where applicable.

We endeavour to maintain accurate, complete, and current information on this site, but we are not responsible if it is not. It should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, complete, or timely sources of information. Prices, descriptions, quantities, availability and continuance of our products and services are subject to change at any time without notice.

We may modify or discontinue any product or service without notice at any time. We are not liable to you or to any third-party for any modification, price change, suspension or discontinuance of any product or service.

Some products or services may be available exclusively online through the website. Some may have limited quantities and are subject to return or exchange only according to our Product Returns Policy.

We may, but are not obligated, to limit the sales of our products or services to any person or geographic region. We may exercise this right on a case-by-case basis.

If stock availability is an issue after an order has been placed, (eg due to an item being damaged, or out of stock), we will contact you first to see if you wish to amend your order to accept another colour or size, or to remove the item from your order.

Some promotional items may have limited supply. If the item is part of continuing items, we will let you know when another order is due to be placed and you can choose to wait for the supply, or we can remove the item from your order. If you remove the item where payment has already been made, we will contact you to process a refund.

We endeavour to display items for sale as accurately as possible. The colours may be affected by the screen of your computer monitor, tablet, or mobile phone.

We may correct any errors or omissions relating to our products or services and may change or update information or cancel orders if any information is inaccurate and may do so at any time without prior notice (including after you have submitted your order).

Payment and order cancellation

All payments for products are processed via Shopify’s secure payment system at the time you place your order. Available payment methods are shown at checkout and include credit/debit cards, After Pay and Direct transfer, or other payment methods supported by Shopify. Orders will not be confirmed until payment is successfully processed.

All prices are listed in New Zealand dollars (NZD) and include Goods and Services Tax (GST) where applicable, unless otherwise stated.

Accuracy of billing and account information

We may refuse any order at our sole discretion, and may limit or cancel quantities purchased per person, per household, or per order — including orders placed by the same customer, credit card, or billing/shipping address, or those we believe are from dealers, resellers, or distributors. If we make a change to or cancel an order, we may attempt to notify you using the email, billing address, or phone number provided at the time of purchase.

When placing an order through Shopify, you agree to provide current, complete, and accurate account, billing, shipping, and payment information, and to maintain the confidentiality of your account details and password if you choose to create a customer account. Shopify may send you transactional emails (such as order confirmations, shipping notifications, and return status updates) on our behalf.

Optional applications / tools

We may provide you with access to third-party applications or tools (apps / tools) which we do not monitor or have any control or input.

You agree that we provide access to such apps / tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We have no liability arising from or relating to your use of such apps / tools.

Any use by you of the apps / tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms of provision by the provider(s).

We may in the future, offer new services and / or features through the website (including, the release of new apps / tools and resources) which are subject to these Terms.

Our Shopify store may integrate with additional third-party applications (such as shipping calculators, payment gateways, or customer account tools). Your use of those applications is also subject to their respective terms and conditions.

Some content, products, and services available via our service may include materials from third parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Input, materials and feedback

We may, on occasion, request input, materials, or feedback (input) from you (such as feedback via a survey, request for photos or mokopuna artwork, request for tenders) or you may choose to send us creative ideas,suggestions, proposals, plans, or other materials, whether online, by email, by post, or otherwise. In such cases you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any input that you forward to us.

We are under no obligation to:

2. pay compensation for any input

• infringe upon the rights of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right
